BY USING THE IDTAG.COM PLATFORM, YOU ARE AGREEING TO BE BOUND BY THE TERMS OF USE BELOW. IF YOU DO NOT AGREE TO THE TERMS OF USE, DO NOT CONTINUE WITH YOUR REGISTRATION.

Lost Pet Alert & Promotional Email Opt In/ Opt Out Agreement

If your animal gets lost and is taken to an animal shelter, rescue group or veterinarian, they will scan the microchip to read its unique 15-digit ID code. This is the number used by SmartTag to identify the pet and retrieve your contact information, which is used to contact you and reunite you with your pet. In the event your pet is missing your contact email will be used to send you lost pet alerts and updates. When you register your pet with SmartTag you agree to Opt In to our Email Alert service and to receive automatic account updates and monthly promotional emails. You cannot opt out of lost pet email alerts, account updates, or company information emails as long as you have an active account with SmartTag, however, you can opt out of our promotional offers and coupon offer emails. To do this, login to your account, click the “Profile Information” tab located on the left-side tool bar on your dashboard. Once in your “Profile Information” page, scroll down to the bottom of the page where you will see the “Opt In Promotional Emails” check box. Check “No” to Opt Out of promotional and coupon emails. By choosing “No” you agree you will no longer receive promotional offers or coupon offers from SmartTag.

 

SmartTag Marketing Communications:

1. If opted-in to our SMS communications, SmartTag will occasionally send you SMS messages with offers and/or new product announcements.

2. You can cancel the SMS service at any time. Just reply “STOP” to the message you’ve received. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

3. If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at support@idtag.com

4. Carriers are not liable for delayed or undelivered messages

5. As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive 1-2 messages per month. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

Definition of Service

For the purposes of this agreement service is defined as follows. The maintenance of Customer contact and pet information in an online database. The maintenance of a call center for the purpose of receiving reports of lost and or found animals and assisting Customer through all contact phone numbers and email addresses listed in Customer’s account. Service begins on the date of a successful completed purchase and subscription with a valid credit card and continues for the period of time specified during the purchase. Years are defined as 365 days per 1-year service purchased. Service ends at the expiration of the service (subscription) contract period purchased. After completion of a contract period, Company has no more obligation or responsibility to provide service of any kind for the Customer. Service is not a GPS system, implanted microchip, or electronic tracking or locating device of any kind.

Ownership of Animals

Customer declares that they are the legal owners of the animals for which the microchips, ID tags and service are being purchased. Company does not condone nor will be held liable for the purchase of tags and service for animals not owned by the Customer. If any animal needs to have a transfer of ownership, an animal transfer form must be completed and sent to the Company for review and approval, once verified by the current owners and new owners. The Company is not liable for any misinformation or misrepresentation by any party.

Company is Not Responsible for Customer Information

Customer acknowledges that entering the microchip or ID tag serial number into the Customer’s IDTag.com web site account is the sole responsibility of the customer, not the Company. Company is not responsible for any of the information contained in the Customer’s account. Company makes does not warrant the authenticity or accuracy of the information contained in a Customer’s account. The maintenance of accurate and current information in the Customer’s IDTag.com Website account is the sole responsibility of the Customer. Customer will hold Company harmless for any lapse in Service or access to customer website account which result from any force outside of Company’s reasonable control or influence including, but not limited to, power outages, Website hosting interruptions, software problems or Company termination. IDTag.com may share any of the categories of non-confidential Customer Information with companies from which a customer has purchased a SmartTag™ pet ID tag. All nonaffiliated companies that act on our behalf and receive Customer Information from us are contractually obligated to keep the information we provide to them confidential, and to use the Customer Information we share only to provide services we ask them to perform or previously agreed upon marketing services. No credit card information will be transmitted outside of IDTag.com systems at any time.

In addition, we may share any of the non-confidential categories of Customer Information with affiliated companies in order to provide marketing support and other services, such as a service provider that distributes marketing materials. These companies may help us to market our own products and services or other products and services that we believe may be of interest to you. Please note that some of our nonaffiliated and affiliated companies may provide you with additional marketing support or materials for services or products other than those of SmartTag™. Company Access of Customer Information

Customer acknowledges that Company employees or agents may access Customer information for the purpose of reporting a lost animal or other business-related reasons. Company does not keep or store Customer credit card information unless otherwise authorized by Customer.

Payments and Renewals

By selecting a 1 year or 5-year protection plan, Customer hereby authorizes SmartTag to maintain and charge the customer’s credit card of record automatically 30 days before the date of expiration of the subscription plan. Customer agrees that the card will be automatically charged each year for a new 1-year subscription plan, unless customer contacts SmartTag via phone to cancel their subscription plan. Prior to your service expiration you will be notified by SmartTag, by email, asking if you would like to continue service. If you do not respond stating you do not want to continue your service, your pet protection service will be automatically continued for 1 more year, and your credit card on file will be charged the annual subscription fee. After this annual fee is charged, no refunds will be applicable. All multi-year discounted plans purchased are non-refundable. SmartTag does not take returns purchased from third party retailers. All ID tags are transferable to any other animal. All service plans will be charged 30 days prior to expiration to ensure owners maintain active pet protection plans for their pets. If a charge fails to renew, owners will be contacted so there is time to update the billing information on file to ensure tags are active.

Limited Responsibility for Lost and Found Reporting

Company does not guarantee that any lost animal will be found. Company does not employ any service for the purpose of search. No agent of the Company will take an active role in searching for any animal. Company shall have no responsibility to make arrangements for the return of any Animal. Company’s only responsibility is to maintain a call center for the purpose of receiving reports of lost or found animals and the maintenance of a website and database of customer’s contact and pet information. Lost pet rewards paid by IDtag.com, must be first reported as lost on our website, and found by a third party, within one week, and our lost animal call center is called by the finder, and the animal is reunited with the owners, verified and approved by IDtag.com to collect the reward.

Cancellation

Company is not liable for any loss of property, nor for the loss of any animal. Customer will hold Company harmless for any damages, real or perceived, incurred by the Customer as a result of owning an animal, or purchasing ID tags and purchasing the service from the Company. Owning an ID tag and purchasing Service from Company is not a guarantee of animal safety, return, or health. Customer acknowledges that Company has no control, influence, or responsibility for the care for any animal. Company is not an insurance company and does not offer any insurance coverage for any losses, costs or expenses relating to the lost or recovered animal.

Limited Liability

If you do not accept these terms, please notify us immediately and we will cancel your subscription. If you do not cancel your subscription within 3 business days of activation of your animal ID registation, it will mean that you agree to this agreement which will be legally binding on you.

Partnerships

Customer agrees that the Company has various partnerships with other pet related companies and will market pet products, services, insurance and other pet related offers to all customers. SmartTag is not liable for any issues with any separate entities, partners or affiliates.

Refunds

All animal protection plans (lifetime, 5 year, 3 year,1 year, etc.) are nonrefundable. In the unlikely event that we cease providing service, whether as a result of a liquidation, bankruptcy, or otherwise, all prepaid subscriptions will be treated as nonrefundable. Service credits will not be refunded in cash, but will be honored in the form of service for the remaining length of the credit should there be any interruptions in service. Unused service credits will expire upon termination of your subscription and may not be transferred to another person or subscription.

SmartTag microchip orders are refundable under the following conditions: The buyer returns an item, in the original condition and count, within 14 days from when their order was received. We charge a 25% restocking fee plus any shipping & handling fees associated with the order.
